Terms and Conditions

The United States Agency for International Development (USAID)’s ASEAN Competitiveness Enhancement Project (“ACE”) maintains this web site ("Web Site") on behalf of the ASEAN Tourism Association (“ASEANTA”), and is responsible for this promotion.

You can access and use this Web Site only if you agree to and accept the following terms and conditions applying to your use ("Terms and Conditions") without limitation or reservation. Please read these Terms and Conditions carefully before accessing and browsing this Web Site. You may not download material displayed on the Web Site for your personal or commercial use. Additionally, you may not modify, reuse, report, or use the contents of the Web Site for public or commercial purposes, including the text, images, audio, and video without ACE’s written permission.

ACE reserves the right to cancel or amend the contest mentioned on the Web Site or these Terms and Conditions at any time without prior notice. Any changes will be posted either within the Website or these Terms and Conditions.

Qualifying Entrants

1. The contest is open only to residents and permanent residents [who are 18 years or older as of (15th February,  2010)] of Asia, Australia, New Zealand, European Union and the United State.
2. Employees of ASEANTA, ACE and its affiliated companies, advertising and promotion agencies, as well as their immediate family members and/or those living in the same household of each are not eligible.

Competition Entries

1. The above contest is valid from 15th March 2010 to 15th June 2010.
2. Entries for each month will close on the 15th of the month (i.e. 15th March - 15th April 2010, 15th April - 15th May 2010, 15th May - 15th June 2010). All subsequent entries will be considered eligible for voting only for the next month's awards.
3. All entries must be received on or before 5pm (GMT +08:00) on 15th June, 2010.
4. There will be a voting period of one month from July 1st-31st 2010 for the winning entries of all the months - which will be used to pick the winner of the grand prize.
5. By submitting the contest entries, each participant thereby 
   (a) specifically authorizes ACE to use such entries as per the "Copyright" terms below;
   (b) represents and warrants that all elements contained in the contest entry
   (i) is original to the participant or fully cleared for use as contemplated herein,
   (ii) does and will not, in any way, violate or breach any of the terms of any other agreement the participant may be a party to,
   (iii) does not contain libelous, tortuous, or otherwise unlawful information, infringe or violate any copyright or other right, or contain any matter the publication or sale of which will violate any federal or state statute or regulation,
   (iv) is not obscene or in any other manner unlawful, and (v) shall not require ACE to pay or incur any sums to any person or entity as a result of ACE’s use or exploitation of the same.
6. Winners may be required to participate in public relations events tied to the campaign to generate press coverage of the contest and the accessories range. This may include, but not be limited to, quotes given for inclusion in press releases and press conferences, interviews, etc.
7. ACE reserves the right to disqualify all entries that do not meet the rules and regulations of these contests. These include entries submitted with invalid or incorrect information.

1. Prizes are non-transferable.
2. Acceptance of any prize shall constitute consent on the winner's part to allow the use of the winner's name, image, voice and/or likeness by ACE for editorial, advertising, promotional, marketing and/or other purposes without further compensation except where prohibited by law. Acceptance of any prize shall constitute a release and discharge of ACE by each winner from any and all liability, claims, demands, causes of action, and/or damages which the winner may have, whether known or unknown at the present time, of any nature whatsoever, arising out of or relating to: (i) the contest, (ii) personal injury and/or property damage, theft or loss suffered by the winner as a result of the use and/or enjoyment of the prize, and/or (iii) any tax liabilities in relation to the contest, prize and/or use or enjoyment of the same. 
3. Results for the first month's prize winners will be announced on 4th May 2010. The winners will also be notified separately by email. ACE reserves the right to deal with all unclaimed prizes in any manner deemed fit. Winners will need to respond to the email in acceptance of the prize. Should this email not be sent and received by the organizer by the requested date, winning status may be revoked. 
4. Subject to the terms and conditions herein, the winners shall receive the following as the prizes and they cannot be the same person (no single writer or photographer can win more than one monthly prize):-

1. The winners of the People’s Choice Awards will be selected from the list of contestants who entered the Contest and will be chosen based on the highest vote, as voted by the users.
2. The winners of the Editor’s Choice Awards will be selected from the list of contestants who entered the Contest and will be chosen based on the judges’ score cards, which will be based on content, research on content, relevance to site themes, style and other criteria
3. In the event that any entrant is disqualified from the Contest, ACE at its sole discretion may decide whether a replacement entrant should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to the Terms and Conditions. 
4. All prizes not collected within fourteen (14) days from the date of notification of win shall be disposed of at ACE’s sole discretion. ACE’s decision regarding the award of all prizes, and/or in every situation including any not covered in these Terms and Conditions, shall be final and binding on all participants in the contest, and no queries, challenges or appeals may be made or entertained regarding ACE’s decision on the same. The receipt by any winner of any prize under this Contest is conditional upon compliance with any and all applicable laws, rules and regulations.

Liabilities

1. ACE cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Contest or as a result of entering the Contest or accepting any prize. ACE is not responsible for any safe custody, return, non-delivery or missing of entries, late, misdirected, problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in the Contest.
2. By entering the Contest or accepting the prizes, You agree that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted against ACE, its parent companies, affiliates, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from the Contest and acceptance of any prize, including without limitation, personal injuries, death and property damage.

Use of Personal Information

1. By entering the contest, You agree:

   (a) ACE will have full copyright to all prize-winning content. (We will use it for both on and offline PR opportunities.)

   (b) ACE will have the right to use/modify all non-prize-winning content on SoutheastAsia.org – but no right to reproduce content in other places

   (c) to the use of your name and/or likeness, without compensation, for ACE’s promotional and marketing purposes; and

   (d) to the use of the information submitted on the contest entry form, without compensation, for ACE’s promotional and marketing purposes; and

2. Each individual participating to this competition acknowledges that:
   
   (a) such disclosure complies with any Privacy Legislation from any country, within the geographical scope of this competition, and the use of such Personal Information by ACE as contemplated by this application (including, without limitation, the disclosure of such Personal Information to SOUTHEASTASIA.ORG's external agencies or third parties)
   
   (b) she/he is authorised to disclose such Personal Information

   (c) such disclosure complies with any Privacy Legislation from any country, within the geographical scope of this competition, and the use of such Personal Information by SOUTHEASTASIA.ORG as contemplated by this application (including, without limitation, the disclosure of such Personal Information to ACE’s external agencies or third parties)

   (d) ACE’s and its affiliated companies respect the privacy of every individual who visits our Web site or responds to our advertisements and contest. Please refer to our Privacy Statement for details.

Disclaimer

Please be advised that all materials posted on the Web Site are subject to public downloading by third party viewers. ACE has taken precautionary steps to deter users from downloading. However, should downloading persist, ACE shall not be held accountable or liable for any damages caused.

Privacy Policy

1. Information – When using the Website, you may be asked to enter Information. The Information will only be used for the purposes explained when you have been asked to enter the Information and/or in accordance with this Privacy Policy.
2. Provision of Information to Third Parties - We will not sell or otherwise transfer the Information to unaffiliated third parties without your approval. If applicable, you will have the opportunity to indicate whether you would like to "opt in" to receiving promotional and/or marketing information about other products, services and offerings from us and/or any third parties.

Analysis of User Behaviour – We reserve the right to perform statistical analyses of user behaviour and characteristics in order to measure interest in and use of the various areas of the Website and to inform advertisers of such information as well as the number of users that have been exposed to or clicked on their advertising banners. We will provide only aggregated data from these analyses to third parties. We are not responsible for any actions or policies of any third parties who request personal information and you should check the applicable privacy policy of that party.
4. Cookies - You should be aware that information and data may be automatically collected through the use of "cookies". "Cookies" are small text files a website can use to recognise repeat users and allow us to observe behaviour and compile aggregate data in order to improve the Website and to target its advertising. 5. Updating or Removing Information - You may notify us of any updates, amendments and corrections to previously collected Information by using the Feedback Form on the Website. Further, upon your request, we will use commercially reasonable efforts to delete Your Information from our database (but in any event such deletion will be carried out within ten (10) business days). However, it may be impossible to delete your entry without some residual information because of backups and records of deletions.
